1. Who We Are and What These Terms Cover
By creating an account or using Honestly, We Are All Human (the “App”), you agree to these Terms. If you don’t agree, please don’t use the App.
The App is operated by:
In these Terms, “we” and “us” mean Cobuildy S.L.
These Terms apply to the iOS app, our website, and anything else we offer under the Honestly, We Are All Human name. Our Privacy Policy explains how we handle your personal data and forms part of your agreement with us.
2. The Service
The App is a daily practice of honest self-reflection. It works like this:
- Morning question. Each day we give you one question.
- Answers lock at the end of the day. You can edit your answer until the end of the day you wrote it. After that, it is saved as written and can’t be changed.
- Evening reflection. In the evening, the App generates a short personal reflection on your answer using artificial intelligence (see section 8).
- Archive. Your answers build a private archive that only you can see.
- Community feed. You can choose to share an answer with other people (see section 5).
- Sets. You can buy access to Sets, which are curated collections of questions. Sets can be private, duet or group, so you can answer with people you invite (see section 9).
We may change, add or remove features over time. We’ll try to give notice of significant changes that affect you.
3. Eligibility and Your Account
You must be at least 16 years old to use the App. By creating an account you confirm that you are 16 or older. If we learn that someone under 16 has an account, we may close it.
To use the App you need an account. You agree to:
- Give accurate sign-up information.
- Keep your login details secure and not share your account.
- Tell us promptly if you think someone else has accessed your account.
You are responsible for activity that happens through your account. One person, one account.
4. Your Answers and Your Content
You own your words. Your answers, and anything else you write in the App (“Your Content”), remain yours.
Private by default. Your daily answers are visible only to you unless you choose to share them to the community feed. Answers in duet and group Sets are visible to the other people in that Set (see section 9).
What we need from you. To run the App, you give us a worldwide, non-exclusive, royalty-free licence to store, process and display Your Content, and to send it to our service providers (including AI providers) for the purposes in these Terms: generating your reflection, moderating shared answers, and operating the App.
Editing window. You can edit an answer until the end of the day you wrote it. After that, it is saved as written and you cannot change it. You can still delete an answer or your account (see section 12), subject to any deletion we must delay for legal reasons.
Your responsibility. You confirm that Your Content is yours to share and doesn’t break the law or anyone’s rights.
5. The Community Feed
Sharing is your choice. You decide, answer by answer, whether to share. Nothing goes to the feed automatically.
How you appear. Shared answers are signed with a nickname you choose, in one of four handwriting styles. Your nickname must not reveal your real identity unless you choose that yourself, and it must not impersonate anyone. Avoid including names, contact details or other personal information about yourself or others in a shared answer.
Who can read. The feed for a given question opens only after you have answered that same question yourself. Then you can read other people’s shared answers to it.
Reactions. You can respond to a shared answer with one of four reactions:
Reactions are for support and recognition. There are no comments, and we may limit or remove reactions that are used to harass or manipulate.
Licence to show your shared answers. When you share an answer, you give us a worldwide, non-exclusive, royalty-free licence to display it, with your nickname, to other users of the App. You can stop sharing an answer at any time, and we will then stop displaying it in the feed. Copies others have already seen or captured outside the App are beyond our control.
Be mindful. Shared answers are visible to other users. Please think before you share something very personal.
6. Community Rules
The feed works because people can be honest in it. When you share or react, you agree not to post or do any of the following:
- Hate, harassment, bullying or threats toward any person or group.
- Sexual content involving minors, or sexually explicit content of any kind.
- Content that encourages or glorifies suicide, self-harm, eating disorders or violence.
- Personal information about other people (names, addresses, phone numbers, workplaces) or anything that identifies a third party.
- Illegal content, or content that promotes illegal activity.
- Spam, advertising, links, or promotion of products, services or other apps.
- Content you don’t have the right to share, or that infringes someone’s rights.
- Impersonation, or misleading others about who you are.
- Attempts to interfere with the App, bypass moderation, scrape content, or reverse-engineer the service.
Sharing a painful experience is welcome. Content that harms others, or that encourages harm, is not.
If you are struggling, please read section 8 for what to do.
7. Moderation, Reports and Appeals
Automated review. Every answer you share is checked by an automated AI moderation system against the rules in section 6 before or while it appears in the feed. Automated systems can make mistakes, so we may also review content ourselves.
Reporting. Any user can report a shared answer from inside the App. We review reports and may remove content or limit reactions, and where rules are broken seriously or repeatedly, restrict or close an account.
What happens to your content. If we remove or restrict your shared answer, we’ll tell you what we did and why, and which rule it broke. Removing a shared answer from the feed doesn’t delete it from your private archive.
Appeals. If you think we got it wrong, you can ask us to review the decision by writing to info@honestlyweareallhuman.com within six months. A person will look at your appeal, and we’ll tell you the result and the reasons.
Out-of-court dispute settlement. If you’re in the EU, you may also be able to use a certified out-of-court dispute settlement body under the EU Digital Services Act. This doesn’t affect your right to go to court.
Illegal content. To report content you believe is illegal, write to info@honestlyweareallhuman.com with a description of the content, why you believe it is illegal, and your contact details.
8. AI Reflections: What They Are and What They Aren’t
Your evening reflection is written by an AI system based on your answer as it stands when the reflection is generated. Later edits to the answer don’t change a reflection that already exists. To create it, we send your answer to an AI provider that processes it on our behalf. We don’t allow our providers to use your answers to train their models. The reflection is shown only to you.
Please keep in mind:
- Reflections are generated automatically. They can be inaccurate, incomplete or off the mark, and you should treat them as a prompt for thought, not as fact.
- The App is not therapy, medical care, or professional advice of any kind, and the reflections are not a diagnosis or treatment.
- The App is not an emergency service, and we can’t monitor it in real time.
If you are thinking about harming yourself or someone else, or you are in danger, please contact local emergency services right away (112 in Spain and the EU), or reach out to a trusted person or a local crisis line.
In Spain you can call the 024 suicide prevention line, which is free and available at all hours.
9. Sets and Payments
The daily question, your private archive, evening reflections and the community feed are free. Sets are curated collections of questions that we sell, and buying access to a Set is how the App earns money. When you buy a Set:
- We show you the price, what the Set includes, and whether access is a one-off purchase or a subscription before you pay.
- You pay through your Apple account using Apple’s in-app purchase system, and Apple’s payment and refund rules apply.
- If a Set is a subscription, it renews automatically unless you cancel at least 24 hours before the end of the current period, and you can manage or cancel it in your Apple ID settings.
- Access is personal to you. Apart from inviting Guests to a duet or group Set as described below, you may not share, resell or copy a Set or its questions.
- Your answers to a Set’s questions are Your Content like any other. In a private Set only you see them. In a duet or group Set the people in that Set see them, as described below.
- We may update, replace or withdraw a Set. If you’ve paid for access to a Set we withdraw, we’ll tell you in advance and, where the law requires, give you a refund or equivalent access.
9.1. Private, Duet and Group Sets
Sets come in three kinds:
Only you answer.
You answer together with one person you invite.
You answer together with several people you invite, up to the limit shown when you buy.
9.2. Inviting Guests
If you buy a duet or group Set, you can invite friends, family and others to answer its questions with you (“Guests”). Guests don’t pay for the Set. A Guest needs their own account and must be at least 16, so you must not invite anyone under 16. Invite only people you know, and use invitations for personal, non-commercial purposes only. A Guest can leave a Set at any time, and you can remove a Guest.
9.3. Who Sees What
In a duet or group Set, each participant’s answers are visible to the other participants of that Set, and only to them, unless someone chooses to share an answer to the community feed. The App shows you this before you answer. Only write what you’re comfortable showing the people in that Set, and don’t share other participants’ answers outside the Set without their permission. The community rules in section 6 and the moderation and reporting process in section 7 apply inside Sets too.
9.4. Guests’ Access
A Guest has access to a Set only while the access you bought is active. If it ends, because a subscription lapses, we withdraw the Set or your account is closed, Guests lose access to the Set’s questions, and answers other people wrote in that Set are no longer shown to them. A Guest’s own answers stay in their own archive. A Guest isn’t a party to your purchase, and any refund or withdrawal right relating to it belongs to you as the buyer.
9.5. Your Right to Withdraw
If you’re a consumer in the EU, you generally have 14 days to withdraw from a purchase. For digital content, you lose this right once access begins if you agreed to immediate access and acknowledged this at checkout. Your other statutory rights, including for digital content that is defective or not as described, are not affected. We’ll update these Terms if our pricing model changes.
10. Our Intellectual Property and Your Licence to Use the App
The App, including its design, name, logo, questions, Sets, text, handwriting styles, software and look and feel, belongs to us or our licensors and is protected by intellectual property laws. Your Content is not part of this.
We give you a personal, limited, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, for your own non-commercial use, under these Terms.
You may not copy, modify, distribute, sell, scrape or reverse-engineer the App or its content, except where the law allows it despite this restriction. The daily questions and reflections are for your personal use and may not be republished at scale or used to train AI models.
The App is distributed through the Apple App Store. These Terms are between you and us, not Apple. Apple isn’t responsible for the App or its content, support, maintenance or warranties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. Apple’s standard licensed-application terms also apply to your use of the App.
11. Privacy and Notifications
Our Privacy Policy explains what personal data we collect, why, who we share it with, how long we keep it, and your rights under the GDPR, including access, correction, deletion, portability and objection. Please read it alongside these Terms.
With your permission, we send push notifications, such as a reminder when the daily question is ready. You can turn them off at any time in your device settings.
12. Suspension, Termination and Deleting Your Account
You can leave any time. You can delete your account in the App or by writing to us. When you do, we delete your answers, reflections, shared answers and reactions, except for data we must keep by law or to handle disputes, and we’ll tell you if so. Deleted content may remain in backups for a limited time before it is overwritten.
We may suspend or close your account if you seriously or repeatedly break these Terms, if we’re required to by law, or if your use puts others or the App at risk. Where we can, we’ll warn you first and explain our reasons. We may also stop offering the App; if we do, we’ll give you reasonable notice and a chance to export or save what matters to you where possible.
Sections that by their nature should survive termination, such as 4, 10, 13 and 14, keep applying.
13. Disclaimers and Limitation of Liability
We provide the App with reasonable care and skill, but we can’t promise that it will always be available, error-free or uninterrupted. Other users’ shared answers are their own views; we don’t endorse them and aren’t responsible for them, although we do moderate as described in section 7.
To the extent the law allows, we are not liable for indirect or consequential losses, or for losses we could not reasonably have foreseen. Our total liability to you for any claim related to the App is limited to the greater of €100 and the amount you paid us in the 12 months before the claim.
Nothing in these Terms excludes or limits liability that can’t be excluded by law, including liability for death or personal injury caused by negligence, for fraud or wilful misconduct, or any rights you have as a consumer under mandatory law.
14. Changes, Governing Law and Contact
Changes. We may update these Terms, for example when we add features or when the law changes. For material changes we’ll notify you in the App or by email at least 30 days before they take effect. If you keep using the App after that, you accept the new Terms. If you don’t agree, you can stop using the App and delete your account.
Governing law. These Terms are governed by Spanish law. If you are a consumer, you also keep the protection of the mandatory consumer laws of the country where you live.
Disputes. Please contact us first at info@honestlyweareallhuman.com so we can try to resolve the issue. If we can’t, disputes are for the courts of Barcelona, Spain, unless you are a consumer, in which case you can bring a claim in the courts where you live. Consumers may also use alternative dispute resolution bodies available in their country.
If a part is invalid. If any part of these Terms is found unenforceable, the rest still applies.
